Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Billefy POS application and related services ("Service"), operated by Billefy ("we", "us", or "our"), an individual/freelancer business based in India. By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Billefy in any capacity, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding agreement to use Billefy. By using the Service, you represent that you meet these requirements.

3. Free Trial

Billefy offers a free trial period of three (3) months to new users. The following conditions apply:

  • The trial is available to new accounts only — one trial per individual or business entity
  • During the trial, access to features may be limited at our discretion
  • No payment information is required during the trial period
  • At the end of the trial, continued access requires a paid subscription
  • We reserve the right to modify or discontinue the trial offer at any time without prior notice

4. Subscription and Payment

After the trial period, access to Billefy requires a paid subscription:

  • Subscription plans and pricing are as listed on the Billefy website or application at the time of purchase
  • Payments are due in advance for the selected subscription period
  • We accept payments through the methods listed on our platform

5. No Refund Policy

ALL SUBSCRIPTION PAYMENTS ARE FINAL AND NON-REFUNDABLE. Specifically:

  • Once a yearly (annual) subscription has been purchased and payment has been received, no refund will be issued under any circumstances
  • This includes but is not limited to: change of mind, business closure, technical issues, or partial use of the subscription period
  • In the event of a dispute, we may at our sole discretion offer account credit, not a monetary refund
We strongly encourage all users to make full use of the 3-month free trial before committing to an annual subscription.

6. Account Responsibilities

You are solely responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Ensuring that all data entered into the Service is accurate and lawfully obtained
  • Obtaining appropriate consent from your customers before uploading their personal data

7. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable local, national, or international law or regulation
  • Transmit any data that is unlawful, harmful, fraudulent, or deceptive
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service for any purpose other than legitimate business billing and POS operations

8. Suspicious Activity and Account Suspension

We take the security and integrity of the Service seriously. We reserve the right to:

  • Monitor accounts for unusual or suspicious activity
  • Temporarily suspend or permanently block any account that we reasonably believe is involved in fraudulent, abusive, or illegal activity
  • Suspend accounts that exhibit signs of unauthorised access, data scraping, or misuse of the Service
  • Terminate accounts without prior notice if a serious violation of these Terms is detected

Suspicious activity includes but is not limited to: unusual login patterns, bulk data exports, attempts to circumvent security measures, and use of the Service for purposes not intended by Billefy.

In cases of account suspension due to suspicious activity, no refund of any subscription fees will be provided. You may contact us at contact@billefy.com to appeal a suspension decision.

9. Data and Intellectual Property

You retain ownership of the data you upload to the Service. By uploading data, you grant Billefy a non-exclusive, royalty-free licence to use, process, and analyse that data for the purposes of operating and improving the Service, as described in our Privacy Policy.

All intellectual property rights in the Billefy application, including software, design, trademarks, and content created by us, remain exclusively owned by Billefy.

10. Service Availability

We aim to provide a reliable and uninterrupted Service. However, we do not guarantee 100% uptime. We reserve the right to:

  • Perform scheduled or emergency maintenance at any time
  • Modify, suspend, or discontinue any feature of the Service with reasonable notice
  • Discontinue the Service entirely with 30 days' notice to active subscribers

11. Limitation of Liability

To the fullest extent permitted by applicable law, Billefy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service. Our total liability to you for any claim shall not exceed the amount paid by you to Billefy in the three (3) months preceding the claim.

12. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

13. Modifications to Terms

We reserve the right to update these Terms at any time. We will notify active users of material changes via email or in-app notification at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts in India.
